CurrentRert Blog In a landmark ruling, U.S. District Judge Aileen Cannon has dismissed the case against former President Donald Trump regarding his handling of classified documents. Judge Cannon cited the improper appointment of Special Counsel Jack Smith as the basis for her decision.

Earlier, Trump had faced serious charges stemming from Special Counsel Jack Smith’s investigation into his possession of classified materials at his Mar-a-Lago residence. The former President was indicted on 37 felony counts, including willful retention of national defense information, conspiracy to obstruct justice, and making false statements. Trump had pleaded not guilty to all charges.

Judge Cannon’s ruling, issued on Monday, stated: “Former President Trump’s Motion to Dismiss Indictment Based on the Unlawful Appointment and Funding of Special Counsel Jack Smith is GRANTED in accordance with this Order. The Superseding Indictment is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution.”

In response to the ruling, Trump expressed his satisfaction during an interview with Fox News, saying, “I’m thrilled that a judge had the courage and wisdom to do this. This has big, big implications, not just for this case but for other cases. The special counsel worked with everyone to try to take me down.”

Trump’s remarks came from Milwaukee, where the Republican National Convention is taking place. He emphasized the significance of the ruling, stating, “This is a big, big deal. It only makes this convention more positive. This will be an amazing week.”

This decision marks a pivotal moment in the ongoing legal battles surrounding the former President, potentially impacting other cases and investigations linked to Special Counsel Jack Smith. The dismissal underscores the importance of adherence to constitutional provisions in the appointment and funding of special counsels.
