PDP Governors Challenge President’s Power to Suspend Rivers State Governor in Supreme Court

CurentReport Blog Eleven governors of the Peoples Democratic Party (PDP) have taken legal action against the President, challenging his authority to suspend the democratically elected governor of Rivers State, Siminalayi Fubara. The governors have approached the Supreme Court to contest the suspension, as well as the declaration of a state of emergency in Rivers State.

The suit, filed by the governors of Adamawa, Enugu, Osun, Oyo, Bauchi, Akwa Ibom, Plateau, Delta, Taraba, Zamfara, and Bayelsa states, is seeking judicial clarification on the powers of the President in such matters. The plaintiffs, through their state Attorneys General, argue that the President overstepped constitutional boundaries with the suspension and state of emergency declaration.

The governors have raised eight grounds in their summons, questioning whether the President has the legal authority to suspend a democratically elected state government. They also seek a determination on whether President Bola Tinubu’s declaration of a state of emergency in Rivers State is in violation of the 1999 Constitution.

As the case progresses, the outcome could have significant implications for the balance of power between state and federal authorities in Nigeria.
