Judge Merchan Rejects Dismissal Request
Judge Juan Merchan dismissed Trump’s motion to overturn the verdict, which cited presidential immunity based on a recent Supreme Court decision. The judge also denied previous attempts by Trump’s legal team to dismiss the case on similar grounds.
Trump, who pleaded not guilty to 34 counts of falsifying business records in the first degree, is not expected to face incarceration. In his decision, Merchan indicated he would likely impose an “unconditional discharge,” meaning no punishment will be enforced.
Background of the Case
The case stems from an investigation led by the Manhattan District Attorney’s Office into alleged hush money payments made during Trump’s 2016 presidential campaign. The payments were reportedly intended to suppress potentially damaging stories.
Despite the conviction, Judge Merchan has rejected the District Attorney’s suggestion to preserve the verdict without further proceedings, emphasizing Trump’s right to appeal the decision.
Trump’s Response
Steven Cheung, Trump’s spokesperson and incoming White House Communications Director, criticized the ruling, calling the case a “witch hunt” and a violation of constitutional principles.
“Today’s order by the deeply conflicted, Acting Justice Merchan in the Manhattan DA Witch Hunt is a direct violation of the Supreme Court’s immunity decision and other longstanding jurisprudence,” Cheung stated.
Cheung reiterated Trump’s commitment to fighting what he called baseless legal challenges, adding, “President Trump must be allowed to continue the presidential transition process and execute the vital duties of the presidency.”
Next Steps
Trump has the option to appear in person or virtually for the January 10 sentencing. Judge Merchan is still reviewing additional motions filed by Trump to dismiss the case.
